Foreigner family residing in France

You want to join your spouse or relative residing in France. The procedure to be followed depends on its status in France:

 

He has been living regularly in France for at least 18 months

The "family reunification" procedure that allows you to join him in France must be completed by your spouse or parent (if you are under 18 years of age) with the territorial directorate of the French Office for Immigration and Integration (OFII ) of his place of residence. He will then have to justify stable and sufficient resources to support your family, as well as adequate housing. It is up to the Prefecture of his place of residence to determine whether these conditions are met.

When the application is accepted by the prefecture, the competent consular service may summon you to issue you a long-stay visa valid for 3 months. It will be followed by the issuance of a residence permit which must be requested from the prefecture of the department of your domicile.

 

He enjoys refugee, subsidiary protection or stateless status

If the refugee, beneficiary of subsidiary protection or stateless person is of legal age, you can apply for the issuance of a long-stay visa under "family reunification" if you are:

  • His spouse/partner/partner (bined by a civil union), at least 18 years old, provided that the marriage or union is earlier than the date of filing of an asylum application

  • A child of the couple, under 19 years of age at the time of filing the visa application

  • His child under the age of 18 or that of his spouse, whose filiation is established only for him or that of his spouse, or whose other parent has died or deprived of his or her parental rights

  • His child under the age of 18 or that of his spouse, entrusted to either under a decision of a foreign court

If the refugee, beneficiary of subsidiary protection or stateless person is an unmarried minor, applications for long-stay visas for family reunification may be submitted by his parents (direct ascendants in the first degree), accompanied if necessary by their unmarried minor children in their effective care.
